1. Agreement to Terms

By accessing the HyperTherapy website (hypertherapy.ca), booking an appointment, or using any services provided by HyperTherapy, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use the website or book any services.

These terms apply to all visitors, clients, and users of the website and services. HyperTherapy reserves the right to refuse service to anyone who does not comply with these terms.

2. Services Description

HyperTherapy provides registered massage therapy services delivered by Ken Zhou, a Registered Massage Therapist (RMT) licensed by the College of Massage Therapists of Ontario (CMTO). All treatments fall within the CMTO-defined scope of practice for massage therapy in Ontario.

Services are offered on a mobile basis (in-home or in-office visits) and, when available, at a clinic location. Service areas include Toronto, North York, Scarborough, Markham, and Richmond Hill. Service availability and geographic coverage may change at any time without prior notice.

3. Booking and Appointments

Appointments can be booked through the HyperTherapy website, by phone at 647-927-9066, or by email at info@hypertherapy.ca. All bookings are subject to availability.

Once a booking is submitted, you will receive a confirmation via email or text message. Your appointment is not considered confirmed until you receive this confirmation. HyperTherapy reserves the right to reschedule or cancel appointments due to unforeseen circumstances, in which case you will be notified as soon as possible and offered an alternative time.

For mobile visits, you must provide an accurate address and ensure a clean, safe, and suitable space for treatment. A minimum area of approximately 8 by 10 feet is required for the portable massage table and therapist movement.

4. Cancellation and No-Show Policy

HyperTherapy requires a minimum of 24 hours' notice for cancellations or rescheduling. This policy is communicated at the time of booking in accordance with CMTO professional standards.

  • Late cancellation (less than 24 hours' notice): A fee of 50% of the booked service price will be charged.
  • No-show: The full service price will be charged if you fail to be available at the scheduled time without prior notice.

Cancellation fees reflect the therapist's lost time and travel costs, particularly for mobile appointments. Exceptions may be made at the sole discretion of HyperTherapy for emergencies or documented medical situations.

5. Pricing and Payment

All prices listed on the HyperTherapy website are in Canadian dollars (CAD) and are subject to applicable taxes. Harmonized Sales Tax (HST) at 13% applies to all massage therapy services in Ontario.

Payment is due at the time of service unless other arrangements have been made in advance. Accepted payment methods include credit card, debit card, Interac e-Transfer, and cash. Online payments are processed securely through Stripe.

HyperTherapy reserves the right to update pricing at any time. Price changes will not affect appointments that have already been confirmed at the time of the change.

6. Deposits

A deposit may be required at the time of booking, particularly for mobile visits. If a deposit is required, the amount will be clearly communicated before you confirm your appointment.

Deposits are fully applied to the cost of your service. In the event of a cancellation made within the required notice period (24 hours or more), your deposit will be refunded in full. Late cancellations and no-shows are subject to the fees outlined in Section 4.

7. Insurance Receipts

As a CMTO-registered Registered Massage Therapist, Ken Zhou provides official insurance receipts that comply with CMTO standards and are accepted by all major extended health benefit providers in Canada, including Sun Life, Manulife, Great-West Life, Blue Cross, Green Shield, and others.

Receipts are issued electronically after each session, typically within 24 hours. It is the client's responsibility to submit receipts to their insurance provider for reimbursement, unless direct billing has been specifically arranged in advance.

HyperTherapy does not guarantee insurance coverage or reimbursement amounts. Clients should verify their coverage with their insurance provider before booking.

8. Health Disclosure

Clients are required to provide accurate and complete health history information before their first treatment. This includes disclosing any medical conditions, injuries, surgeries, medications, allergies, or other health concerns that may be relevant to massage therapy treatment.

Failure to disclose relevant health information may compromise treatment safety and effectiveness. HyperTherapy is not liable for adverse outcomes resulting from incomplete or inaccurate health disclosures.

The therapist reserves the right to modify, adjust, or decline to provide treatment based on health concerns disclosed during the intake process or observed during the session. This is done in the interest of client safety and in accordance with CMTO professional standards.

9. Informed Consent

All massage therapy treatment requires informed consent, which will be obtained prior to the start of each session. You have the right to ask questions about the proposed treatment plan, techniques, expected outcomes, and potential risks before providing consent.

In accordance with CMTO standards, treatment of sensitive areas (such as the chest, inner thigh, or gluteal region) requires additional written consent. This consent will be obtained separately and must be given voluntarily. You may withdraw consent at any time during the session without penalty.

Consent is ongoing. You have the right to stop treatment, modify the treatment plan, or request changes to pressure or technique at any point during your session.

10. Limitation of Liability

Massage therapy is a regulated health profession in Ontario and is not a substitute for medical treatment, diagnosis, or advice from a physician or other licensed healthcare provider. Clients should consult their doctor for any medical conditions or concerns before beginning massage therapy.

Results from massage therapy vary from person to person. HyperTherapy does not guarantee specific outcomes from any treatment session. Ken Zhou, RMT, and HyperTherapy shall not be held liable for any injury, aggravation of pre-existing conditions, or adverse effects that may occur during or after treatment, provided that the therapist has exercised reasonable professional care consistent with CMTO standards of practice.

To the fullest extent permitted by applicable law, HyperTherapy, its owner, and its agents shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the website or services.

11. Intellectual Property

All content on the HyperTherapy website, including but not limited to text, images, photographs, graphics, logos, branding, and design, is the property of HyperTherapy and is protected under applicable Canadian intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on this website without prior written permission from HyperTherapy.

12. Privacy

HyperTherapy collects, uses, and protects personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and the Personal Health Information Protection Act (PHIPA) of Ontario. Health records are maintained in compliance with CMTO record-keeping standards.

13. Changes to Terms

HyperTherapy reserves the right to update or modify these Terms of Service at any time without prior notice. Changes will be posted on this page with an updated “Last updated” date.

Your continued use of the website or services after any changes constitutes your acceptance of the revised terms. We encourage you to review this page periodically to stay informed.

14. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these terms or your use of HyperTherapy's website or services shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario.
